As an attorney, licensed by Texas for 27 years and a physician licensed by Texas for 41 years, I know neglect and malpractice when I see it.  I can depose any opposing medical expert who attempts to change facts or misrepresents the standard of care.  There are many experts, “hired guns,” who are willing to make up facts and distort scientific principles to protect bad nursing homes and bad physicians.  I hold them accountable and demonstrate their dishonesty.  

I was the Medical Director of a nursing home and know the standard of care that elderly residents are supposed to receive. Elder abuse is never acceptable and those who commit it must be held accountable.  I have spent the past two decades representing plaintiffs in medical malpractice cases involving elder injured by nursing home abuse and neglect. 

I saw many elderly patients brought to the emergency room from nursing homes where they had broken hips, shoulders, arms and legs. Sadly, I saw many patients with bedsores that required hospitalization and ultimate skin grafting. Sometimes family members found their parent suffering unexplained fractures and bed sores.  

As our population ages, many more seniors will be heading to facilities in every part of the country. Sadly, some of these facilities are poorly run by people who should not be allowed to care for those who cannot fend for themselves.

Medical Malpractice

I understand how heart wrenching it is to suffer from medical malpractice and how difficult it is to bring a claim against a physician or hospital one trusted.  However, when a surgeon makes mistakes performing laparoscopic gallbladder (cholecystectomy) surgery it is the patient who suffers.  The anatomy of the gallbladder and the surrounding vessels and bile ducts is not complicated, and a surgeon must correctly identify every vessel and bile duct to be cut.  Cutting structures blindly without proper identification leads to disastrous results.  It is the patient who must suffer thru additional surgical procedures to repair the damage. 

I began practicing as director of emergency services at a Houston area hospital in 1979.  As an emergency physician, I treated critically ill patients suffering from major trauma as a result of automobile and train crashes, shootings and stabbings, broken bones, dislocations, fractured skulls and every manner of traumatic injury.  

I delivered babies in the hospital as well as three of them in automobiles. Many of these emergency patients suffered from medical illnesses ranging from sore throats and earaches to severe pneumonia and meningitis.  I have sutured thousands of lacerations, reduced shoulder and hip dislocations and treated many burns.   

I assisted on hundreds of surgical procedures including removal of gallbladders (cholecystectomy), resection and removal of the stomach, resection of tumors from the liver and abdomen, bowel and colon resections, breast surgery for cancer as well as cosmetic improvement, removal of brain tumors, neck and back surgery, hip and knee replacement and open surgical treatment of limb fractures.

I have been licensed to practice medicine in Texas since 1978 and to practice law in Texas since 1992.  As a trial lawyer, I have been lead-counsel in many cases involving medication overdoses, incorrectly connected IV pumps, birth injuries, spinal injuries, broken hips and limbs, serious traumatic brain injuries, physical abuse and sexual assault.  

I tried successfully tried cases involving nursing home neglect, bed sores, brain injuries and bone fractures that resulted from a preventable fall or abuse.  I have also tried cases involving complex personal injury, traumatic brain injuries, defective medical products and medical malpractice in Texas, Georgia, Arkansas, and Florida.

Using my combined scientific, medical and legal training, I know how to discredit dishonest expert witnesses whose opinions wander away from accepted medicine and science methodology. I talk to juries about medicine the way I talked to my patients; I use plain clearly understood language. On a number of occasions, with just a few days of notice, I have come into court and successfully cross-examined expert witnesses I have never before seen. This provided the winning tipping point.

Ms. Gardner’s primary practice area include representing employees in labor and employment law disputes and medical malpractice appellate issues. She has previous experience working on landlord tenant, municipal, and environmental law cases. Ms. Gardner is a graduate of The University of Texas at Austin, where she earned a bachelor’s degree in print journalism and University of Houston Law Center where she earned her J.D. She is a volunteer of the Ojai Raptor Center and is dedicated to helping rehabilitate injured wildlife.
